1. Introduction
These Terms of Service ("Terms") govern your use of the services provided by Bizmecha Empire (Registration No. 202603062772, MA0343419-D), operating under the brand name BizMecha, with its registered address at 2828, Kg Pisang, Kupang, 09200 Kupang, Kedah, Malaysia.
By using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. Description of Services
BizMecha provides WhatsApp-based automation and business operations services for small and medium enterprises (SMEs), including but not limited to:
- Instant lead notification via WhatsApp when new leads are received from Meta Ads or web forms
- SLA monitoring and automatic follow-up escalation for sales teams
- AI-powered daily staff check-ins via WhatsApp
- Automated weekly and monthly boss reports delivered via WhatsApp
- Monthly PDF performance summary reports
3. Eligibility
Our services are intended for registered businesses operating in Malaysia. By subscribing to our services, you represent that you are authorised to enter into this agreement on behalf of your business.
4. User Obligations
As a user of BizMecha services, you agree to:
- Provide accurate and current business information
- Ensure your team members are aware of and consent to WhatsApp-based communications
- Comply with all applicable laws, including Malaysia's Personal Data Protection Act 2010 (PDPA)
- Not use the service for any unlawful, fraudulent, or harmful purposes
- Maintain the confidentiality of your account credentials
5. Service Availability
BizMecha strives to maintain service availability at all times. However, we do not guarantee uninterrupted or error-free service. Downtime may occur due to maintenance, updates, or factors beyond our control, including third-party service disruptions (Meta, WhatsApp Cloud API).
6. Payment and Subscription
Service fees and subscription terms will be communicated to you prior to activation. Payments are due as agreed upon during setup. BizMecha reserves the right to modify pricing with reasonable notice.
7. Data and Privacy
Your use of BizMecha services is also governed by our Privacy Policy. We process data in accordance with Malaysia's Personal Data Protection Act 2010 (PDPA).
8. Intellectual Property
All content, branding, software, and materials associated with BizMecha are the intellectual property of Bizmecha Empire. You may not reproduce, distribute, or create derivative works without prior written consent.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Bizmecha Empire shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for the services in the preceding three (3) months.
10. Termination
Either party may terminate the service agreement with thirty (30) days written notice. BizMecha reserves the right to suspend or terminate services immediately if you breach these Terms or engage in activities harmful to our platform or other users.
11. Changes to Terms
BizMecha reserves the right to update these Terms at any time. Material changes will be communicated via email or WhatsApp. Continued use of services after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
